Doing your own Labour Market Testing in-house?
If you're currently conducting your own in-house Labour Market Testing, it's time to reconsider.
Outsourcing this process to a trusted third party like JobSource adds a layer of objectivity and avoids potential conflicts of interest. Agents recommend this approach to prevent applications from being perceived as mere "box-ticking" exercises.
Companies that handle LMT themselves often experience higher refusal rates due to doubts about the genuineness of the testing process. By entrusting the task to an independent job agency like JobSource, you can mitigate these risks.

Highly skilled foreign workers.
With thousands of highly-skilled foreign workers residing in Australia on temporary visas and access to overseas recruitment, employers can fill crucial positions with ease.
To recruit foreign workers, employers must sponsor them under specific visa categories like the Temporary Skills Shortage visa (subclass 482), the Skilled Employer Sponsored Regional (provisional) visa (subclass 494), or the Employer Nomination Scheme visa (186). Labour market testing is often required as part of the nomination process to demonstrate the unavailability of suitable Australian candidates for the positions.
As of Dec 11th 2023, Labour Market Testing involves advertising the job nationally on two websites, for a minimum of 28 days, depending on the visa stream. The advertisement should be published no more than (currently) four months before nominating a migrant for a TSS visa and must include proof of publication along with a comprehensive report on the applicants' suitability.

Migration Strategy Update
on Labour Market Testing
On the 11th of December 2023 the Australian Government released its new Migration Strategy. The 100 page document outlines its “clear vision” of the Migration Program today, together with planned changes to improve the program going forward.
What does this mean for Labour Market Testing?
Right Now (December 2023)
Labour Market Testing remains much the same. It is still required for several key Visa and Subclasses as before (Click image on right for full information links)
The requirement to advertise positions through Workforce Australia has been removed for new nominations lodged on or after Dec 11th 2023.
Two, prominent, national-reach advertisements are still required.
In the Medium to Long Term (Late 2024 - 2025)
The validity period of LMT reports will increase from 4 to 6 months.
The indicative timeframe is late 2024. Expect this to change around Jan 2025.The government says it will CONSIDER moving away from employer conducted labour market testing to independent verification of labour market need. The indicative timeframe is also stated as late 2024.
The commitment to ‘consider’ seems far from certain or guaranteed, so for the medium term at least, it would appear that Labour Market Testing will still be required (with the adjustments mentioned above) until at least early 2025.
Longer term, the government may, after due consideration decide to replace labour Market testing with a new independent verification of labour market need. That however, does not appear to be a certainty at this point in time.
